The Islamabad High Court stopped the by-election in NA-95 Mianwali.

The Islamabad High Court rejected the request of Imran Khan's lawyer to immediately suspend the disqualification of Imran Khan in the Tosha Khana reference, however, the court stopped the Election Commission from holding the by-election on the seat of Mianwali.


Islamabad High Court Justice Aamir Farooq heard the plea against Imran Khan's disqualification in the Tosha Khana reference, in which Barrister Ali Zafar appeared before the court on behalf of the PTI chairman.


At the beginning of the hearing, Justice Aamir inquired whether you submitted any request for submission of additional documents. On which Ali Zafar said that the Election Commission has submitted a request to submit the ongoing notification, Imran Khan was disqualified and de-seated as a member of the Assembly.


The court inquired whether this reference came from the speaker. On this, Ali Zafar said that yes, this reference was sent by the Speaker, on which the decision of disqualification was pronounced, the Election Commission has to give its findings on the reference, the Election Commission has to answer the questions within ninety days. Every Member of the Assembly is required to submit details of his assets by June 30. If he does not submit the returns within 120 days or gives false information, the member will be guilty of corruption, misrepresentation, giving false information. According to the law, the punishment is imprisonment up to three years and fine, not disqualification.


The lawyer of Chairman Tehreek-e-Insaaf requested the court to suspend the decision of his client's disqualification, to which Justice Amir Farooq said that we are not suspending the decision of the Election Commission, we are stopping the holding of the by-election.


Later, the court stopped the Election Commission from conducting the by-election on Mianwali seat NA-95 and issued a notice to the Election Commission on the petition against Imran Khan's disqualification.
